In 2024, the Kerala government revised the court fee structure for cheque dishonour cases under Section 138 of the Negotiable Instruments Act. The updated fees are as follows: For cheque amounts up to ₹10,000: A court fee of ₹250 is applicable. For cheque amounts exceeding ₹10,000: A fee equivalent to 5% of the cheque amount is imposed, with a maximum cap of ₹3,00,000. Appeals by the accused to the Sessions Court: A court fee of ₹1,000 is required. Appeals by the complainant to the High Court: The fee is set at half of the amount paid in the Trial Court. Revision petitions by the complainant to the High Court: The fee is 10% of the cheque amount. Revision petitions by the accused against conviction: A fee of ₹1,500 is applicable. These revisions were implemented following recommendations from a committee led by Retired Justice V. K. Mohanan and took effect on April 1, 2024. LIVE LAW The amendments were incorporated into the Kerala Court Fees and Suits Valuation Act, 1959, as part of the Kerala Finance Bill, 2024.
